General Terms and Conditions of Sale of access tickets to the Gardens of Villa della Pergola

By placing a purchase order on the website www.giardinidivilladellapergola.com, the user declares that they have reached 18 years of age. The platform is intended exclusively for end users and not for intermediaries such as travel agencies or travel agents, who must send booking requests to info@giardinidivilladellapergola.com.

Receipt of the order constitutes conclusion of the contract. The Gardens of Villa della Pergola undertake to provide the user with the leisure service, which may be enjoyed under the terms and conditions provided, on the pre-established date and time slot, upon conclusion of the contract, which is formed upon receipt of the order.

It is specified that the service purchased on the website www.giardinidivilladellapergola.com is excluded from the right of withdrawal, pursuant to Article 7, paragraph 1, letter b) of Legislative Decree 185/1999 and Article 59, paragraph 1, letter n) of the Consumer Code.

For matters not expressly regulated in these Terms and Conditions of purchase, reference is made to the provisions of Legislative Decree 22 May 1999, no. 185, as well as to the Consumer Code and the applicable provisions of the Italian Civil Code.

Information relating to the transaction (card number, expiry date, security code) will be transmitted to the entity responsible for processing via encrypted protocol, without any third party being able, in any way, to access it. Such information will never be displayed or stored by Stone S.r.l.

1. Ownership of the website and information on the seller

The products and services offered on the Website are offered for sale by Stone S.r.l., which is responsible for the sale of all products and services pursuant to these General Terms and Conditions of Purchase (GTC).

2. Subject

These GTC govern the distance sale, through the Website, of access titles (Tickets) to users of the services of the Gardens of Villa della Pergola (Users), in order to access the gardens (the Gardens of Villa della Pergola).

3. General information to the User on the GTC

These GTC are accessible at any time on the Website in the section Terms and Conditions of Sale and may be printed and/or stored by the User. Consultation of the information contained on the Website is free of charge.

These GTC apply to purchase contracts entered into by Users for products and services offered on the Website and placed for sale by the Gardens of Villa della Pergola.

These GTC are drafted pursuant to Legislative Decree 9 April 2003, no. 70 (E-commerce Law) and Legislative Decree 6 September 2005, no. 206 (Consumer Code).

These GTC may be modified at any time. Any changes will be effective from the moment of their publication on the Website in the section Terms and Conditions of Sale. The GTC applicable are therefore those in force at the date of transmission of the purchase order of a Ticket. Users are therefore invited to consult, before making any purchase, the version of the GTC in force at the time of the purchase order.

4. Platform Users

The booking platform is intended exclusively for end users. Use by intermediaries, such as, by way of example but not limited to, travel agencies, tour operators or travel agents, is not permitted.

Such parties, for any booking requests, are required to contact the Management directly at the email address: info@giardinidivilladellapergola.com.

5. Prohibition of External Operators

Within the Gardens, the activity of external tour guides, external translators or external escorts not authorized by the Management is not permitted.

Any visiting or accompanying services are managed exclusively by internal staff or by subjects expressly authorized.

6. Cancellation of Non-Compliant Bookings

The Management reserves the right, at its sole discretion, to cancel at any time tickets purchased through the platform where it appears that the purchase has been made by unauthorized subjects, including but not limited to travel agencies, tour operators or intermediaries.

7. Prohibition of Resale

The resale, for any reason, of purchased tickets is strictly prohibited. If resale by unauthorized third parties is ascertained, the tickets will be considered null and void for access purposes, without any right to refund.

8. Pre-Purchase Information

The User may consult the different types of tickets offered by the Gardens of Villa della Pergola available for online purchase in the Terms and Conditions of Sale section of the Website. Tickets and services are issued exclusively for the specific date and/or period indicated during the purchase process.

The prices of Tickets and services offered by the Gardens of Villa della Pergola are indicated in euros, and any applicable promotions or discounts are specified at all times on the Website.

By purchasing a Ticket or any of the services offered on the Website, the User confirms that they have carefully read these GTC. To this end, the User declares that the GTC are adequate to provide valid and informed consent to any purchase.

The rights and obligations of the User during and after the purchase are subject to these GTC, as well as to the rules set out in the regulations of the Gardens of Villa della Pergola.

Purchase is permitted only to natural persons who have reached the age of 18 (eighteen). By proceeding with the purchase, the User declares that they have the legal capacity required to be bound by these GTC and to make purchases on the Website.

The User declares that they are aware of, understand, and fully accept these GTC. The purchase of Tickets or other services, whether for personal use or for use by third parties, is carried out under the sole responsibility of the User.

9. Information relating to the conclusion of the sales contract

In order to purchase a Ticket or a service available on the Website, the User must follow the instructions provided at each stage of the purchase process in the Ticketing section at the following link: www.giardinidivilladellapergola.com, and provide all required information.

Before completing the purchase, the User must expressly tick the relevant box as confirmation of full understanding and acceptance of these GTC.

Successful completion of the purchase will be confirmed by email to the address provided by the User during the purchase process.

Once the online purchase has been completed, no changes or refunds will be permitted (see Article 10 below).

The languages available to Users for the conclusion of the sales contract are Italian and English. Customer Service is able to communicate with Users in the same languages.

10. Price and Payment Methods

The price of the selected Ticket or service is the one indicated on the Website. The price is also stated in the Ticket confirmation email. The Ticket price includes any applicable VAT. Tickets are issued in digital format and are made available to the User in such format.

With regard to payment methods and related security measures, the Gardens of Villa della Pergola guarantee that appropriate measures have been adopted and that such measures comply with current technological security standards. All sensitive data are transmitted via a secure connection and are protected by the SSL certificate installed on the Gardens of Villa della Pergola Website.

The Website uses Stripe as its payment processing system. Stripe is an external online payment platform that allows the Website to accept payments by debit card, prepaid card, or credit card. It is secure and fast. Stripe complies with PCI standards and is certified at Level 1, currently the most rigorous level in the payment sector. This standard is also ensured for the company using the service through the native STRIPE.JS library. Through this functionality, the Website www.giardinidivilladellapergola.com does not handle sensitive card data, which are instead transferred directly to Stripe’s secure server without any intermediate processing.

In order to guarantee the security of payments made on the Website and to prevent fraud, the Gardens of Villa della Pergola may request the User, by email, to send, by the same means and within a deadline deemed essential in the interest of the Gardens of Villa della Pergola pursuant to Article 1457 of the Italian Civil Code, a copy (front and back) of an identity document. In the event of failure to provide the requested document within the specified deadline, the sales contract shall be deemed automatically terminated pursuant to the aforementioned article of the Civil Code.

11. Ticket Delivery and Collection

Ticket codes are delivered to the email address provided at the time of the order.

12. Discrepancies between Tickets Received and Purchased

Without prejudice to the provisions set out in the preceding articles, in all cases of discrepancies between the Tickets received and those purchased, the User may contact the Gardens of Villa della Pergola using the contact details referred to in Article 1 of these GTC.

The request will be handled and reviewed as soon as possible.

If the User has purchased a reduced-price ticket without being entitled to it, they will be required to pay the difference on site on the day of the visit.

13. Admission to the Gardens of Villa della Pergola

The Ticket must be presented, either in printed or digital form, at the ticket office. Tickets are valid only for the specific date selected at the time of purchase and indicated on the Ticket itself. The Ticket does not include services or other products not expressly specified at the time of purchase.

14. Absence of the Right of Withdrawal

No changes, modifications, or refunds are permitted for Tickets purchased for a specific date or time period, in accordance with Article 59, letter n) of the Italian Consumer Code.

15. Assistance and Complaints

Users may request information, send communications, or submit complaints by contacting Customer Service using the details provided in Article 2 of these Terms. Requests will be handled and reviewed as soon as possible.

16. Prohibitions

Tickets are issued with a unique code. The resale or transfer of Tickets to third parties is prohibited. The purchase of Tickets by travel agencies, travel agents, or intermediaries through the platform is also prohibited. Tickets are non-transferable.

17. Changes and Refunds

It is specified that the service purchased on the website www.giardinidivilladellapergola.com is excluded from the right of withdrawal pursuant to Article 7, paragraph 1, letter b) of Legislative Decree 185/1999 and Article 59, paragraph 1, letter n) of the Consumer Code. Tickets are therefore not modifiable in terms of date or time. Tickets are non-refundable and non-changeable. No refund requests will be accepted in cases of reconsideration, inconvenience, or personal circumstances of the visitor. Refund requests will only be considered in the event of closure of the Gardens of Villa della Pergola due to force majeure attributable to the Gardens, closures imposed by regulations, or technical reasons.

18. Visit Modality

Visits take place exclusively in the form of guided tours. The duration is approximately 80 minutes. The Management and the Head Guide may, at any time, modify the route and/or duration of the visit for technical or operational reasons.

19. Language of the Visit and Informational Materials

Guided tours are conducted exclusively in Italian. Visitors are provided with written informational materials in English, French, and German. Guides may, where possible, provide answers to Users’ questions in English; however, this shall not constitute the provision of a guided tour service in a language other than Italian. To benefit from guided tours in other languages, it is necessary to book a dedicated private tour, organized by the Management, which allows the selection of the language from those available.

20. Private Tours and Language Selection

Dedicated private tours may be booked, subject to availability and prior request to the Management. Private tours allow for a customized visiting experience, including the possibility of selecting the tour language from those available at the time of booking.

Confirmation of the requested language is subject to the availability of qualified staff.

21. Blooming and Climate Change

Blooming periods are indicative only. The timing of blooming varies depending on several factors beyond our control. These include climate change, which leads to sudden temperature fluctuations, periods of drought alternating with concentrated periods of excessive rainfall, and/or extreme weather events (e.g., hailstorms, heavy downpours). Unfortunately, these increasingly frequent phenomena have direct consequences on the life cycle of plants, and so-called peak blooming can no longer be predicted. For these reasons, the periods indicated to the User are to be considered indicative only.

22. Food

It is not permitted to bring food into the Gardens of Villa della Pergola. The use of the Gardens as a picnic area is prohibited, including the road leading to the Gardens of Villa della Pergola (Via privata Montagu).

23. Animals

It is strictly prohibited to bring any type of animal into the Gardens of Villa della Pergola. This is because the Gardens host wild animals typical of the Ligurian fauna that must be protected and preserved. Additionally, there are plants within the Gardens that are toxic to domestic animals.

24. Rain

Visits are guaranteed even in the event of rain. Any suspension due to particularly adverse weather conditions will be assessed directly on site on the day of the visit.

25. Parking

The Gardens do not provide parking facilities for visitors. Therefore, the purchase of a ticket does not grant the right to park any vehicle within the Gardens of Villa della Pergola or along the road leading to the Gardens.

26. Late Arrival

Access to the Gardens of Villa della Pergola is permitted starting from 10 minutes before the scheduled visit time. The visit begins at the exact time indicated (e.g., 9:30, 11:30, 15:00, 17:00). Access will not be permitted to those arriving more than 10 minutes after the start of the visit (e.g., 9:40, 11:40, 15:10, 17:10). No refunds or schedule changes will be allowed (see Article 13).

27. User Conduct During the Visit

Guided tours within the Gardens of Villa della Pergola are organized with the aim of providing an educational, enjoyable, and safe experience for all participants.

Users are encouraged to carefully read these Terms and Conditions before booking in order to fully understand the expectations and responsibilities during the guided visit. It is important to comply with the rules and regulations established by the organization of the guided tour to ensure safety and respect for other participants and the surrounding environment. By following these guidelines, Users help ensure that the visit to the Gardens of Villa della Pergola is safe, environmentally respectful, and enjoyable for all. The staff of the Gardens of Villa della Pergola may require any visitor (and, in the case of minors, the responsible adult) whose behavior is deemed disruptive or dangerous to leave the premises immediately, without any refund of the ticket paid. Before starting the tour, Users must familiarize themselves with the rules of the Gardens and ensure compliance throughout the visit.

Users must:

• comply with all rules and follow the instructions of guides and staff of the Gardens of Villa della Pergola;
   
• maintain appropriate and respectful behavior towards other participants, guides, and staff (including avoiding noisy, disorderly, or aggressive conduct and refraining from smoking during the tour);
   
• behave respectfully towards the surrounding environment;
   
• remain on designated paths and follow all instructions provided by guides and staff;
   
• not leave the group;
   
• avoid any behavior that may interfere with the experience of other participants;
   
• respect the private property visited during the tour;
   
• not touch plants, objects, or any elements within the Gardens;
   
• not disturb wildlife;
   
• not collect flowers, fruits, or leaves;
   
• not use external guide services or translation services provided by third parties (to benefit from guided or translated visits, a dedicated private tour must be booked through the Management, allowing the selection of the preferred language);
   
• not litter within the Gardens and dispose of waste properly in designated bins.
   

With regard to minors:

• minors must be adequately prepared for the visit (including appropriate nutrition and suitable clothing and footwear);
   
• minors must always be supervised by a responsible adult;
   
• minors must follow the instructions of the guide;
   
• minors must not disturb other participants;
   
• minors must not touch plants, objects, or animals, as this may be dangerous due to the presence of thorny or poisonous plants;
   
• minors must never be left unattended.
   

Marriage proposals or similar activities are not permitted during the visit. For such occasions, a dedicated private event must be arranged. In case of violation of this rule, an immediate fee of €9,500 will be charged.

28. Dress Code

Users must dress appropriately for the guided visit, taking into account weather conditions and the nature of the activities. The use of walking or trekking shoes, hats, sunglasses, and layered clothing is recommended. The Gardens of Villa della Pergola reserve the right to deny entry to any person wearing costumes and/or disguises or whose appearance is considered disruptive to the enjoyment or safety of other Users. Any member of staff may refuse entry to, or remove from the Gardens at any time and without refund, any ticket holder who is not dressed appropriately. This includes clothing displaying commercial, political, controversial, obscene, or offensive signs or logos.

29. Photography and Video

Within the Gardens, it is strictly prohibited to take professional photographs or videos and/or any content intended for commercial and/or promotional purposes. Photography and video recording for exclusively personal use are permitted, provided they are carried out without the use of tripods, additional lighting, or any equipment that may interfere with the guided tour. If the option to visit the interiors has been purchased, it is strictly prohibited to take photographs, including for personal use, inside Villa della Pergola and the Villino of Villa della Pergola. It is also prohibited to photograph the façades of the Villa and the Villino.

For any other use (e.g., commercial, promotional, or publication purposes), including on social media for commercial purposes, prior authorization must be requested from the Press Office of the Gardens of Villa della Pergola (press@villadellapergola.com). It is also prohibited to upload photographs taken within the Gardens to paid image-sharing or sales platforms (e.g., Shutterstock). In any case, publication with watermarks or similar indications is not permitted, and no copyright and/or rights may be claimed over images taken or recorded within the Gardens of Villa della Pergola. Such images remain the exclusive property of Stone S.r.l., which reserves the right to request their removal at any time in accordance with company policies. The purchase of a ticket implies automatic and implicit acceptance of these policies. It is also prohibited to take photographs for location scouting purposes without prior authorization. Photographs for promotional purposes are strictly prohibited.

30. Use of Recording Devices and Smart Glasses

For the purpose of protecting the privacy of our staff and other visitors, the use of smart glasses, wearable recording devices, or any form of continuous audio or video recording is strictly prohibited within the Gardens of Villa della Pergola.

Any unauthorized use of such devices may result in immediate removal from the premises without refund.

The Management reserves the right to seek compensation for any damages suffered, including reputational, economic, or privacy-related damages, and to take any further legal action deemed appropriate.

31. Photography Services for Events and Celebrations

Photography services for events and celebrations require a specific request for the exclusive rental of the entire venue, to be submitted to info@giardinidivilladellapergola.com. Such activities are not permitted during guided tours (e.g., wedding photo shoots).

32. Breach of Conduct Rules

In the event of violations of these rules, the staff of the Gardens of Villa della Pergola may require participants to comply with the rules or to leave the tour and exit the Gardens immediately, without any refund. In serious cases, staff may request the intervention of law enforcement authorities, and the Management reserves the right to take legal action against Users depending on the severity of the violation and the damage caused.

33. Liability

Users agree to be held liable towards the Gardens of Villa della Pergola for any damage caused, directly or indirectly, to any area of the Gardens and their contents (including plants, objects, statues, furnishings, animals, etc.), or for any injury caused by Users to staff members, representatives of the Gardens, or other visitors during the visit.

By way of example and not limitation, Users further agree that:

• if acting as the responsible adult, they shall also be responsible for all minors under their supervision;
• if acting as the organizer of a group, they shall be jointly and severally liable (together with the group participants concerned) for any damage caused by members of the group.

Furthermore, the Gardens of Villa della Pergola shall not be liable for any loss, damage, costs, or expenses incurred by Users or relating to any personal belongings during the visit.

The liability of the Gardens towards Users shall, in any case, be limited to the price of the admission ticket.

Under no circumstances shall the Gardens be liable towards Users or third parties for loss of personal items, damage to personal property, or any indirect or consequential damages related to items left in lockers.

34. Special Visits to the Interiors of the Villas

It is strictly prohibited to take photographs inside or of the façades of Villa della Pergola and the Villino of Villa della Pergola. Access to interior areas with strollers or similar equipment is not permitted. Visitors participating in special visits are informed that display cases are equipped with alarm systems and must not be touched. It is also prohibited to cross safety barriers. Any damage caused to furnishings, interiors (including floors and walls), will be entirely borne by the visitor, who will be required to compensate for the damages.

35. Groups and Bookings

For groups of more than 9 (nine) persons belonging to the same family unit or otherwise forming a single organized group, booking through the standard ticketing system is not permitted. Such groups must book a dedicated private tour, subject to prior request and confirmation by the Management. The Management reserves the right to cancel bookings made in violation of this provision, without any right to a refund.

36. Force Majeure

The Gardens of Villa della Pergola shall not be liable for any total or partial inability to provide the service due to force majeure events, including but not limited to natural events, extreme weather conditions, disasters, epidemics, governmental measures, strikes, or other unforeseeable events.

37. Applicable Law and Jurisdiction

These Terms are governed by Italian law. Any dispute relating to the application, execution, or interpretation of these Terms or the sales contract shall fall under the jurisdiction of the court of the place where the User resides or has elected domicile. In any case, the User has the right to bring proceedings before the competent ordinary court and, where applicable, to initiate alternative dispute resolution procedures pursuant to Articles 141 et seq. of the Italian Consumer Code.

38. Privacy

The Gardens of Villa della Pergola shall process Users’ personal data in compliance with applicable data protection laws. For further information, please refer to the Privacy section.

39. Use of Name and Image

The use of the name “Gardens of Villa della Pergola” or the image of the location for commercial, promotional, or professional purposes is prohibited without prior written authorization.

40. Acceptance of Terms and Conditions

Access to the Gardens of Villa della Pergola, as well as the purchase and/or use of tickets, implies full, express, and unconditional acceptance of these General Terms and Conditions of Sale and the applicable regulations. The User declares that they have read, understood, and accepted all applicable provisions prior to accessing the Gardens. Lack of knowledge of these Terms may not, under any circumstances, be invoked as grounds for dispute.

 

 

The Stone Srl, in its capacity as Data Controller (hereinafter also referred to as the "Controller"), pursuant to and for the purposes of EU Regulation no. 2016/679 (hereinafter, "GDPR"), provides you with some information regarding the processing of personal data collected during the ticket purchase activities for access to the Gardens of Villa della Pergola (hereinafter also simply referred to as the Gardens).

Processed Personal Data and Data Source
In the context of ticket purchase activities, the Controller processes personal identification and contact data (e.g., name, surname, email address, residential address, and mobile number) related to the person making the reservation.

All this data is provided directly by the person making the reservation.

Purposes, Legal Basis of Processing, and Nature of Provision
Your data will be processed for the following purposes:

• Booking Management - The legal basis for the processing is the execution of contractual obligations pursuant to Art. 6, para. 1, lett. b) of the GDPR. Providing personal data is mandatory for the completion of the booking; failure to provide the data makes it impossible to execute the table booking.
• Defense of the Controller's Rights in Judicial and Extrajudicial Proceedings - The legal basis for data processing is the pursuit of the legitimate interest pursuant to Art. 6, para. 1, lett. f) of the GDPR, consisting of the protection of the Hotel's interests and rights. Providing personal data is mandatory for the completion of the booking; failure to provide the data makes it impossible to execute the table booking.

Data Recipients
The data will be processed exclusively by the personnel of Stone Srl specifically appointed for this purpose.

Data Retention Period
The data subject to processing is retained only for the time strictly necessary to carry out the aforementioned activities/purposes.

Data Transfer
Your data will not be transferred outside the EU.

Data Subject's Rights
Data subjects have the right to obtain from the Data Controller, where applicable, access to personal data and the rectification or erasure of the same or the restriction of processing concerning them or to object to processing (Articles 15 et seq. of the Regulation).
